Geoffrey Allan Wall, a Victoria-area man charged by the U.S. Securities and Exchange Commission for his part in a pump-and-dump scheme that generated as much as $77.3-million in profits, has asked a judge to dismiss the case. (All figures are in U.S. dollars.) He says that the SEC took too long to file the case, bringing the charges outside of the five-year window. He also says that the SEC relies on "imprecise, vague and unparticularized" allegations against him.

The request from Mr. Wall comes as part of a case in which the SEC claims that he and others unloaded millions of shares in 10 companies in the midst of paid promotions. As they did so, they failed to disclose that they controlled most or all of the tradable shares of the companies, the SEC says. Mr. Wall's co-defendants are B.C. residents Jay Scott Kirk Lee and Benjamin Thompson Kirk.

With the case yet to reach the trial stage, Mr. Wall has asked that the judge dismiss the charges in their entirety. In a motion filed on Monday, Aug. 8, he says that the SEC charged him after the five-year limitation period had expired. Much of the case as it pertains to Mr. Wall stems from events that occurred in 2013. The SEC did not file its case until Dec. 9, 2021, well outside of that five-year window, the motion states.
