The Globe and Mail reports in its Monday edition that Ottawa plans to revise last year's Competition Act that allowed Canadians to sue for deceptive marketing and required companies to back up their green claims. A triple bylined item, led by guest columnist Julien Beaulieu, writes that this decision is framed as a way to reduce "investment uncertainty." However, Ottawa's claim that "greenwashing provisions" are hindering environmental efforts does not seem justified. It claims companies are reversing green efforts due to new greenwashing rules, but the guest columnists say they have only seen a reduction in marketing claims, not actual initiatives. Claiming a causal link after a few months of enforcement seems unfounded. The government believes that reduced environmental claims from companies is negative. However, this could indicate that the law is effectively curbing unsubstantiated claims and restoring market credibility. It is premature to label the amendments a failure, especially as corporate disclosure trends continue to adapt amid a broader anti-ESG backlash. The Competition Act mandates that companies support their green claims with an "internationally recognized methodology," a term that remains undefined.
