Stephen Pineau, the former chief executive officer of OTC Markets listing Viscount Systems Inc., has won another $150,000 in damages against Business in Vancouver over a defamatory story from 2015. Mr. Pineau complained that Business in Vancouver (better known as BIV) referred to him in an article about fraud and the mishandling of company money. The story, which was on BIV's website for five years before the publication apologized, led to Mr. Pineau being rejected for at least one job.
The victory for Mr. Pineau is contained in a judgment released by the Court of Appeal for British Columbia on Monday, March 31. The decision adds to a $252,000 judgment that Mr. Pineau previously won in a lower court. The ruling means that the defendants, Glacier Media Inc. (which owned BIV) and Tyler Orton, are liable for $402,000 in total.
The case arose from a story that Mr. Orton wrote on Jan. 15, 2015, about corporate whistle-blowers and how they could prevent "mishandling of funds" if they were properly protected. The story pointed out that the U.S. Securities and Exchange had made payouts to corporate whistle-blowers as high as $30-million (U.S.), but no such program existed in Canada.
