Globe says BMO sees Ont. mull unexplained wealth orders

The Globe and Mail reports in its Thursday edition that Ontario is mulling adopting unexplained wealth orders, a legal tool used to seize assets believed to be acquired through crime. The Globe's Alexandra Posadzki writes that these orders help law enforcement disrupt money laundering by requiring asset owners to explain their sources of income. Critics have argued the orders infringe on the Canadian Charter of Rights and Freedoms, by removing the presumption of innocence. The Ontario government launched a public consultation seeking input on a proposal from the Ministry of the Attorney-General that the province introduce unexplained wealth orders. Submissions are due Aug. 31. British Columbia, Manitoba and Nova Scotia have all adopted unexplained wealth orders. Saskatchewan has implemented a similar tool. B.C. courts have upheld a new tool allowing unexplained wealth orders. Recently, Supreme Court Justice Neena Sharma granted such an order against Kevin Miller, who was linked to a multimillion-dollar pump-and-dump scheme involving Jammin' Java stock. Justice Sharma rejected Mr. Miller's claims that the legislation is unconstitutional and demanded he explain how he obtained millions in a lawyer's trust account.
