The Lower Similkameen Indian Band has filed a case in the Supreme Court of British Columbia challenging a permit to expand the Copper Mountain mine belonging to Hudbay Minerals Inc., claiming that the provincial government failed to carry out the proper consultations. The band sees the mine as a "major infringement" on its rights and says that it requires "free, prior and informed consent" before work can proceed. Among other things, the band cites the government's adoption of UNDRIP (the United Nations Declaration on the Rights of Indigenous Peoples).

The case comes just weeks after the expansion, called New Ingerbelle, received government approval. The expansion targets the Ingerbelle section of the mine, which was worked in the 1970s and 1990s. The expansion will extend the life of the mine until 2040, which is good news for the 800 employees. The expansion went through the government's approval process, which included consultation with the Lower Similkameen Indian Band going back to at least January, 2024.
