SEC defendant Left says jury got it wrong

Andrew Left, the activist short-seller convicted on criminal charges in California arising from a two-year scheme to manipulate several Canadian and U.S. listings, has asked the judge to throw out his conviction. Prosecutors said that Mr. Left used his investment publication, Citron Research, to generate $20-million in trading profits in what amounted to a "garden-variety pump-and-dump scheme." (All figures are in U.S. dollars.) The stocks that he targeted included TSX Venture Exchange listings Cronos Group Inc. and Namaste Technologies Inc.

Mr. Left's request is set out in a motion for acquittal filed on Oct. 6, 2026, in federal court in California. The filing comes about four months after a jury convicted him at the conclusion of a 14-day trial in Los Angeles. As Mr. Left sees things, the jury reached the incorrect verdict. "Andrew Left was convicted of securities fraud for publishing accurate statements and sincerely held opinions about public companies without disclosing that he planned to trade on them -- a theory this Court held, before trial, is not a crime," his motion states.
